Video: Dem Rep says Libya action ?illegal?

Eliot Spitzer challenged Rep. Michael Capuano (D-MA) on his lawsuit against Barack Obama and American military action in Libya this morning on In The Arena, hitting the bipartisan legal fight on both pragmatic and legal grounds. Capuano tells Spitzer that he remains a supporter of Barack Obama, but that this is about more than just one particular President ? and that Congress has to take part in these decisions. Capuano acknowledges that courts have been loathe to intervene in a way which essentially orders a President to disengage, but that these circumstances are extraordinary and unprecedented:

I?m not sure what Spitzer was thinking about Congressional actions in military operations. Both post-9/11 wars were authorized by Congress in explicit acts (AUMFs) that authorized the President to conduct military operations in Iraq and Afghanistan. The first AUMF was even broader, authorizing a global war against al-Qaeda and nations that harbored or supported them. While it?s true that Congress hasn?t explicitly declared war in decades, they have authorized every military action since then, at least those which lasted more than a few days. Our involvement in the attack on Libya has dragged on for three months.

Precedent, then, won?t be a handy refuge for the President.� However, the odds of getting a court to order a withdrawal from the hostilities is nearly zilch.� For one thing, it would cross into our treaty obligations with NATO partners, a refuge that Obama has just recently begun to use.� For another, courts may be inserting themselves into war-fighting issues that don?t directly impact on combat situations, but it would be a highly extraordinary intervention indeed for a court to order a retreat under any circumstances.� The most a court might do is order Obama to seek Congressional approval and impose penalties for non-compliance.

That prompts another question, though, which is why Obama is so reluctant to seek Congressional approval in the first place.� Had he done so immediately, he almost certainly would have gotten it.� Obama would probably have gotten approval two weeks ago when the deadline was approaching, and still would be more likely than not to succeed if he asked for it now.� Congress would take some time to criticize his lack of respect for the co-equal branch, but in the end Congress would be just as loathe to order a retreat as the courts.� What exactly does Obama fear from such a request?

NBC?s Late Night host Jimmy Fallon speaks honestly about his own company?s missteps in handling the transition from Jay Leno to Conan O?Brien?and then back?calling the original decision to tell Leno he?d eventually be replaced by O?Brien ?an insult.?

In an interview set to air tonight on CNN?s Piers Morgan Tonight, Fallon describes the decision to decide Leno?s fate years ahead of time?and while he was number one in late night?made no sense. ?I think that?s bizarre. If you?re number one and somebody says, in five years somebody?s going to take your job, I don?t know what that means. If I was Jay Leno, I?d be like, what are you talking about?? Fallon said O?Brien, whose tenure as host of The Tonight Show was cut short and now hosts Conan on TBS, ?didn?t get much of a chance.?

As for the fighting between NBC (which has since changed ownership, with Comcast taking a controlling interest), Leno and Conan, Fallon described it as an awkward family feud:

It?s almost like watching your family fight. If you?re going to do it, get it over with, and I?m just going to sit uncomfortably at the table. Can I have more wine, please?

You can easily see them splitting the votes of party activists.

Boehner warns Obama: If Congress doesn?t authorize the Libya mission by Sunday, you?re in violation of the War Powers Act

First the debt-ceiling standoff, now this. Man, that?s going to be one awkward golf summit.

Dear Mr. President:

Five days from now, our country will reach the 90-day mark from the notification to Congress regarding the commencement of the military operation in Libya, which began on March 18, 2011. On June 3, 2011, the House passed a resolution which, among other provisions, made clear that the Administration has not asked for, nor received, Congressional authorization of the mission in Libya. Therefore, it would appear that in five days, the Administration will be in violation of the War Powers Resolution unless it asks for and receives authorization from Congress or withdraws all U.S. troops and resources from the mission?

Given the mission you have ordered to the U.S. Armed Forces with respect to Libya and the text of the War Powers Resolution, the House is left to conclude that you have made one of two determinations: either you have concluded the War Powers Resolution does not apply to the mission in Libya, or you have determined the War Powers Resolution is contrary to the Constitution. The House, and the American people whom we represent, deserve to know the determination you have made.

Therefore, on behalf of the institution and the American people, I must ask you the following questions: Have you or your Administration conducted the legal analysis to justify your position as to whether your Administration views itself to be in compliance with the War Powers Resolution so that it may continue current operations, absent formal Congressional support or authorization, once the 90-day mark is reached? Assuming you conducted that analysis, was it with the consensus view of all stakeholders of the relevant Departments in the Executive branch? In addition, has there been an introduction of a new set of facts or circumstances which would have changed the legal analysis the Office of Legal Counsel released on April 1, 2011? Given the gravity of the constitutional and statutory questions involved, I request your answer by Friday, June 17, 2011.

I wrote about Boehner?s War Powers brinksmanship a few weeks ago but I?m still not sure what his game is. He was, I think, cowed into demanding that O seek authorization of the mission after Kucinich?s resolution demanding full withdrawal from Libya started to gain traction with Republicans. Boehner knew that having a chunk of the caucus support a measure like that would risk a conservative split between hawks and libertarian types, so he rammed through his own milder proposal instead that put the ball on authorization back in Obama?s court. The White House?s reaction: *Shrug.* Now Boehner is dropping this ultimatum on him, which, if Obama complies, would force ? precisely the sort of divisive vote among Republicans in the House that I thought Boehner was trying to avoid by torpedoing Kucinich. I don?t get it.

Maybe JB thinks a court battle over the War Powers Act would be politically useful? It?d certainly underscore the perceptions of Obama among some lefties and libertarians as a lawless Bushian cowboy, eager to protect his kingly prerogative to wage war without anyone?s approval. But it?ll also bolster the perception among hawks that he?s a stronger-than-expected C-in-C who?s unwilling to let Congress pull the rug out from under airmen eager to complete their mission. And of course, a legal battle also risks polarizing Republicans on the constitutionality of the War Powers Act. All of which is to say, while I respect Boehner for sticking to the law, he?s sticking to it to a surprising and not necessarily politically advantageous degree. If he?s that down on the mission, why didn?t he force a vote on Kucinich?s resolution without offering any alternatives?

Here?s McCain suggesting that the White House will make the case to Congress for the mission within the next day or two, although he?s unclear on whether that means a request for authorization or just a little ?FYI? session. I?m guessing the crux of Obama?s argument will be that there are no servicemen in harm?s way over there, only drones and other unmanned technology, and therefore Congress doesn?t have to approve anything. Oh, by the way: I might have missed it, but did John King ask a single question about the War Powers Act at the debate last night? This subject has, after all, come up now and again over the past three months since Obama decided unilaterally to commit U.S. assets to the Libya mission. One would think he might have been able to slip it in between asking the candidates whether Moe, Larry, or Curly was their favorite stooge or whatever.

CNN Poll: Sarah Palin most like Ronald Reagan

Somehow, I missed this in a summary I read of a CNN poll released yesterday ? probably because the summary doesn?t mention it, even though the full poll results do. Of all the candidates who are either running or still considering a run for the presidency, Sarah Palin most reminds voters of conservative hero and former President Ronald Reagan. (Well, technically, ?No GOP candidate? tops the list, but Sarah Palin receives the next-highest proportion, a respectable 16 percent.) Unfortunately for Palinistas, at the moment, Palin?s not even really among those ?considering a run for the presidency.?

But Palin?s popularity wasn?t the take-home lesson of the poll. As the CNN headline put it, the moral of the poll was this: Republicans want a winner.

According to a CNN/Opinion Research Corporation survey released Sunday morning, three-quarters of Republicans and GOP leaning independent voters say they want a party nominee who can defeat President Barack Obama in 2012, even if that person doesn?t agree with them on every issue. That?s up seven percentage points from January.

Only 24 percent say that they want a candidate who agrees with them on every issue even if that person may not be able to beat Obama next year, down five points from the beginning of the year.

It?s oft-repeated that ultimate electability ought to be of first concern even in primary elections. The old Buckley rule: Pick the most conservative candidate who can win.�If that?s the case, perhaps the candidates tonight should worry less about proving their conservative chops and focus instead on making a presidential impression. Articulate a clear message, defend controversial positions, but, mostly, just try to rise above the fray.

The ideological purist in me has a hard time rooting for a candidate I disagree with more than another candidate for any reason. That also makes me wish candidates would be more willing to walk into the weeds. Ultimately, I trust the presidential presence will take care of itself: As I?ve argued before, voters will naturally think of the eventual nominee as more qualified for the presidency than a squabbling contender for the nomination.

But the electability factor is certainly something to keep in mind throughout this debate, especially as one of the key factors that contributes to the ability to win is name recognition ? and several candidates stand to benefit in that regard from this very first debate. (Former Godfather?s Pizza CEO Herman Cain, Rep. Michele Bachmann (Minn.) and former Pennsylvania Sen. Rick Santorum all come to mind.) And, of course, in the end, it all comes down to this: Whoever wins the GOP nomination would in all likelihood make a better president than Obama ? and Obama?s who?ll the nominee will have to beat.

President Obama Presented Ideas to Accelerate Job Growth and America?s Competitiveness at Jobs Council Meeting

Today, President Obama traveled to Durham, NC to meet with the Jobs and Competitiveness Council�at the corporate and U.S. manufacturing headquarters of Cree, a leading manufacturer of energy efficient LED lighting.� While at Cree, the President toured the company?s LED lighting product assembly facility, met with the Jobs Council and delivered remarks to Cree employees, Jobs Council members, local business owners and representatives from nearby engineering colleges and universities.

The President?s Council on Jobs and Competitiveness is led by GE Chairman and CEO Jeff Immelt and is composed of representatives from various sectors of the economy andleaders in diverse industries -- people running large and small companies that represent millions of Americans helping the economy run every single day. The Jobs Council held their first meeting at the White House on February 24, 2011.� At that time the Council committed to holding their second meeting outside of Washington, DC.� Cree?s facility, located in the heart of North Carolina?s Research Triangle Park area, was selected to hold the second meeting.

In his remarks�today, the President commended Cree for exemplifying the potential of American innovation, manufacturing and advanced technology:

Today the small business that a group of N.C. State engineering students founded almost 25 years ago is a global company.� It?s got 5,000 employees.� Next month, your new production line will begin running 24/7.� And soon you?ll add another 400,000 square feet of space on a new site next door.� So you?re helping to lead a clean energy revolution.� You?re helping lead the comeback of American manufacturing.� This is a company where the future will be won.

He also discussed the role of his Council on Jobs and Competitiveness and detailed some of the recommendations to address short-term, medium-term and long term economic growth and job creation that they presented to him today:

And today, with the leadership of the Jobs Council, we?re announcing an all-hands-on-deck strategy to train 10,000 new American engineers every year.� So -- and by the way, our Jobs Council, led by Jeff Immelt, they?re doing this not counting on a whole bunch of federal funding.� Private sector companies are teaming up to help us promote STEM education, to offer students incentives to finish those degrees, and then to help universities fund those programs.� They?re going to double their summer internship hiring.

We?re talking about companies like Intel, whose CEO Paul Otellini is here today.� And Paul is heading up our task force for the Jobs Council in helping to figure this out, because he understands Intel?s survival depends on our ability to get a steady stream of engineers.� I?ve been, by the way, to the Intel plant out in Oregon.� It is unbelievable.� It?s out of -- something out of science fiction.� And I pretended like I understood what they were saying the whole time.

But that?s what?s going to drive our competitiveness in the future.� We know that if we?re going to maintain our leadership in technology and innovation, our best companies need the world?s brightest workers ?- American workers.

Now, that brings me to a second idea that we discussed backstage.� At Cree, you?re putting people back to work in a field that has the potential to create an untold number of new jobs and new businesses right here in America -? and that?s clean energy.� And my administration has invested heavily in clean energy manufacturing, because I want to see the LEDs and solar panels and wind turbines and electric cars of tomorrow made right here in the U.S of A.� I want them made right here.

We invested in this company with a tax credit that allowed you to boost capacity and lower costs and hire hundreds of new workers.� And with a grant from the Department of Energy, you?ve made incredible breakthroughs in smart grid technology to transmit clean, renewable energy across the country more efficiently at less cost.

Now, breakthroughs like these have the potential to create new jobs in other sectors of the economy as well.� Think about it.� Cree makes energy-efficient lighting that can save businesses and consumers a lot of money.� And there are a lot of buildings out there that need upgrading.� And there are a lot of workers ready to do the upgrades.� Construction workers were hit harder than anybody by recession.� Almost one in six construction workers are out of work.� And that makes no sense at a time when we?ve got so much of America that needs to be rebuilt.

�So this is what led us to create what we?re calling the Better Buildings Initiative -? putting people back to work doing the work that America needs done.� Upgrading buildings for energy efficiency could save America?s businesses up to $40 billion a year on their utility bills.� And obviously that $40 billion could be better spent growing and hiring new workers.� It will boost manufacturing of energy-efficient products like those made here at Cree.� It will put contractors and construction workers back on the job.� It is a win-win-win-win proposition.

�So today, the members of my job council updated me on their efforts to push this initiative in the private sector.� And they?re working closely with a champion for this kind of energy innovation, President Bill Clinton, who I asked to co-lead the effort with them.

With fifteen straight months of private sector job creation and seven straight quarters of growth we are moving in the right direction, but the President is not satisfied with the pace of job creation and we all agree that there is more that can be done to accelerate job growth.

Additionally, the president acknowledged that these ideas aren?t solutions to every problem we face, but stressed that:

Slowly, steadily, they?re helping us to move forward.� We?re going to pursue these ideas and any good ideas that are out there, no matter where they come from.� Because even though this is a big country with a great diversity of opinion -- as you discover when you?re President -- we won?t agree with each other on everything, we can agree on some basic things.

We can agree on educating our children and training our workers to be the best in the world.� We should be able to agree on investing in the research and technology that leads to new ideas and new industries.� We should be able to agree on developing clean energy and manufacturing jobs that come with it.� It makes sense for us to rebuild our infrastructure and all the jobs that it can create.� That?s what?s going to be required to grow our economy.� That?s what it takes to help our people prosper.� That?s how we?re going to get to the future that we dream about for our children and our grandchildren.

VMware Acquisition Spree Continues with Digital Fuel Acquisition

VMware announced that it will acquire Digital Fuel, an IT financial software-as-a-service provider, for an undisclosed amount. Last week, Globes speculated that Digital Fuel would be acquired for $85 million.

VMware has been on an acquisition spree, having acquired Socialcast and SlideRocket in the past two months.

Digital Fuel was founded in 2000 and sells software for managing service level agreements (SLAs) and other financial aspects relating to IT. It's an interesting move that compliments VMware's existing set of products for managing virtual machines.

Digital Fuel competes with Apptio, a market partner with VMware.

First Lady Michelle Obama Addresses the National Partnership for Women and Families

Yesterday, the First Lady was the keynote speaker at the 40th anniversary gala for the National Partnership for Women and Families, where she spoke about the Administration?s commitment to women and children, and the Partnership?s many accomplishments.

As the First Lady said, thanks to the work of the National Partnership for Women and Families the ?landscape of this nation has been fundamentally changed for the better: our workplaces are more family-friendly, women and girls do have more opportunities, and many discriminatory practices have been completely abolished.?

We know these are victories for all Americans.� That is why since day one, this Administration has been fighting for women and families.� In her remarks, the First Lady highlighted how the Affordable Care Act, the changes to earned income and child tax credits, and the nomination of Supreme Court Justices Sonia Sotomayor and Elena Kagan have advanced the ideals the National Partnership, the Administration, and advocates across our country have been fighting for.

Yet, there is still more work to be done.� In order to continue making progress, the First Lady also spoke about the need to mentor future leaders.� She said, ?if we truly want to keep moving forward, our focus must not only be on the next set of issues, but on the next set of leaders, as well.� And it?s our responsibility to engage and inspire that next generation.� It?s our responsibility to reach back and keep pulling up those promising young leaders.?

How free is your state?

The Mercatus Center at George Mason University undertook a study of personal liberty in each of the 50 states, based explicitly on ?an individual-rights framework.?� First started in 2009, Mercatus has fine-tuned the study to include more policy variables ? and that?s bad news for Massachusetts.� Thanks to the health-insurance mandate as well as a number of other restrictive measures, the Bay State has fallen to 46th among the states for freedom:

The Bay State ranks near the bottom of a new ?Freedom in the 50 States? study, which found the health-care law, gun laws, taxes and a string of other ?nanny state? rules on smoking, seat belts, transfats and firecrackers makes Massachusetts one of the least free states in the nation.

New Hampshire, the commonwealth?s ?Live Free or Die? rival to the north, ranked first in freedom, in the study by the libertarian Mercatus Center at George Mason University. Massachusetts trailed at 46th.

?The big takeaway is that Massachusetts is not doing well overall in terms of freedom,? said study co-author William Ruger, despite the state?s laissez faire attitude toward gay marriage and pot. ?There?s this kind of stereotype or myth that the deep blue states are more economically restrictive but more personally free. But the data doesn?t actually bear that out . . . Liberals tend to want to constrain your freedom in all areas.?

Really?� Well, let?s take a look at the bottom 5 states to test that theory:

  • 50th: New York
  • 49th: New Jersey
  • 48th: California
  • 47th: Hawaii
  • 46th: Massachusetts

Yes, these all seem to fit that profile, don?t they?�� The only real surprise in the bottom 10 is Alaska, usually seen from the lower 48 as home to a more libertarian spirit.� The study marks Alaska low mainly for its fiscal policy:

Alaska?s big problem is fiscal policy. Over a quarter of the state?s workforce is employed by state or local government, and that figure does not include federal employees. Alaska has the highest debt and government spending to personal income ratios in the country. However, Alaska does extremely well on personal freedom, scoring fifth on our ranking. Reasons for its score include fully legalized possession of small amounts of marijuana (accomplished through a court ruling), the least-restrictive gun laws in the country, strong asset-forfeiture protections, recognition of same-sex domestic partnerships, and possibly the best homeschooling laws in the country. On economic regulation, Alaska does poorly on labor law, occupational licensing, and eminent-domain reform but relatively well on health-insurance regulation.

As for Massachusetts, it?s exactly what you think:

Massachusetts has a reputation as a liberal state par excellence, and therefore it might be surprising to discover that the state ranks higher on economic than personal freedom. The state has fallen significantly since 2007, due in part to the notorious Romneycare health-insurance reform. Tax rates remain about average, and the government payroll is remarkably small. The biggest fiscal problem for Massachusetts is debt, which equals more than a quarter of personal income. Meanwhile, on personal freedoms the state has highly restrictive gun laws, bicycle- and motorcycle-helmet laws, personal injury and uninsured motorist auto-insurance mandates, fairly restrictive gambling laws, a total fireworks ban, extremely strict private- and homeschool requirements, terrible asset-forfeiture rules, extremely strict campaign-finance laws, high cigarette taxes, and a total statewide smoking ban. On the positive side, the state did decriminalize marijuana possession in 2008. Same-sex marriage remains in place. Labor laws are subpar, except on workers? compensation funding (self-insurance is allowed).

How about my state of Minnesota?� We came in at #34, which is still 14 places above the state I left to move here (California):

Minnesota?s taxes and spending are somewhat higher than average, although debt and government employment are not. Social services spending and individual income taxes stand out as particularly high. Some striking facts about Minnesota include the following: the state still has blue laws for alcohol, low-level marijuana possession is decriminalized, the state lacks helmet laws and prohibits sobriety checkpoints but requires personal injury and underinsured motorist auto insurance coverage, health insurance coverage mandates are the third most costly in the country, occupational licensing is the second worst in the country, asset forfeiture puts the burden of proof on the owner, and cigarette taxes are high. The state has improved by allowing its minimum wage to lapse to the federal standard.

On the latter point, I believe that the state did that only after Congress raised the minimum wage in 2007 ? just before the economy tanked.

So which state in the union is the most free?� Why, it?s the one with ?Live Free or Die? as its motto.� New Hampshire gets to #1, but that?s not to say it?s perfect:

New Hampshire is, by our count, the freest state in the country. Depending on weights, however, it really shares the slot with South Dakota. New Hampshire does much better on economic than personal freedom and on fiscal than regulatory policy. Under unified Democratic control in 2007?2008, the state saw a respectable increase in freedom. A smoking ban was enacted, but so were same-sex civil unions. Taxes, spending, and fiscal decentralization remain more than a standard deviation better than average, and government debt actually went down slightly. Gun laws are among the most liberal in the country, but carrying a firearm in a car requires a concealedcarry permit. Effective retail-tax rates on wine and spirits are zero. Marijuana laws are middling; lowlevel possession could be decriminalized like it is in Maine, while low-level cultivation could be made a misdemeanor like it is in both Maine and Vermont. New Hampshire is the only state in the country with no seatbelt law for adults. It lacks a motorcyclehelmet law but does have a bicycle-helmet law and authorizes sobriety checkpoints. State approval is required to open a private school. Homeschool laws are slightly worse than average; standardized testing and recordkeeping requirements are stricter than those in most states. Eminent-domain reforms have gone far. The state?s liability system is one of the best, but campaign-finance regulations are quite strict. The drug law-enforcement rate is low and dropping, while arrests for other victimless crimes are high and dropping. Asset-forfeiture law is definitely subpar, with potential for abuse.

Assuming that every governor rumored to be thinking of a run for the GOP presidential nomination gets into the race, which one would get the individual-liberty nod based on this study?� Palin?s Alaska comes in at 44th, while Tim Pawlenty?s Minnesota gets 10 places above that.� Chrsi Christie?s New Jersey is second-to-last, which means we need Christie to do some work there rather than on the national stage.� Jon Huntsman?s Utah is above average at 20th, but Rick Perry?s Texas wins the prize at 14th.� However, Mitch Daniels? Indiana wins the bronze medal at #3, which might have impressed primary voters had he thrown his hat into the ring.

Is iMessage an Enterprise Trojan Horse?

Of course, the big Apple related news of the week came out of WWDC: iOS5, iCloud and iMessage. And it's that last service that ZDNet's Larry Dignan and Dennis Howlett make note of.

Dignan writes: "Apple's iMessage is a direct assault on BBM, which is arguably RIM's most marketable item." Howlett agrees, asking whether Apple just launched an enterprise trojan horse.

"It's not so long ago that Apple's premium pricing on laptops in particular was thought to exclude the prospect of a wholesale change away from Windows based machines," Howlett writes. "However the fact I see iPad as the de facto executive device of choice implies that money can be found where a device offers perceived superior value."

Yesterday, the First Lady was the keynote speaker at the 40th anniversary gala for the National Partnership for Women and Families, where she spoke about the Administration?s commitment to women and children, and the Partnership?s many accomplishments.

As the First Lady said, thanks to the work of the National Partnership for Women and Families the ?landscape of this nation has been fundamentally changed for the better: our workplaces are more family-friendly, women and girls do have more opportunities, and many discriminatory practices have been completely abolished.?

We know these are victories for all Americans.� That is why since day one, this Administration has been fighting for women and families.� In her remarks, the First Lady highlighted how the Affordable Care Act, the changes to earned income and child tax credits, and the nomination of Supreme Court Justices Sonia Sotomayor and Elena Kagan have advanced the ideals the National Partnership, the Administration, and advocates across our country have been fighting for.

Yet, there is still more work to be done.� In order to continue making progress, the First Lady also spoke about the need to mentor future leaders.� She said, ?if we truly want to keep moving forward, our focus must not only be on the next set of issues, but on the next set of leaders, as well.� And it?s our responsibility to engage and inspire that next generation.� It?s our responsibility to reach back and keep pulling up those promising young leaders.?

NATO: Oh, by the way, we?re trying to kill Qaddafi now

Well ? yes, of course they are. As has been painfully obvious to even casual observers of the Libya war, you?re not going to reach any sort of sustainable stasis in Tripoli or elsewhere unless you-know-who has been retired. That?s why they?ve been trying to kill him for weeks, in fact. But such are the wonders of international multilateralism that the Security Council would only sign off on a resolution limiting the mission to protecting civilians, not removing the cancer who?s been threatening those civilians for 40 years. Hence this passage in Obama?s speech about Libya on March 28:

Of course, there is no question that Libya -? and the world ?- would be better off with Qaddafi out of power. I, along with many other world leaders, have embraced that goal, and will actively pursue it through non-military means. But broadening our military mission to include regime change would be a mistake.

The task that I assigned our forces -? to protect the Libyan people from immediate danger, and to establish a no-fly zone -? carries with it a U.N. mandate and international support. It?s also what the Libyan opposition asked us to do. If we tried to overthrow Qaddafi by force, our coalition would splinter. We would likely have to put U.S. troops on the ground to accomplish that mission, or risk killing many civilians from the air. The dangers faced by our men and women in uniform would be far greater. So would the costs and our share of the responsibility for what comes next.

Fast-forward to May 26, after two months of stalemate and grumbling in Congress about Obama?s disregard for the War Powers Act:

Mr. Obama?s description of the objectives has shifted. In a speech to the nation in late March, he described the effort as simply one of protecting civilians, and the White House denied that ousting Colonel Qaddafi was critical to that effort. ?Broadening our military mission to include regime change would be a mistake,? he said. While sporadic attacks on civilians continue, the United States and its allies have largely achieved that objective, NATO and American officials contend. The rebel-held ground in eastern Libya is secure, and rebel forces aided by allied air power have pushed back loyalist Qaddafi forces from the contested port city of Misurata.

But Mr. Obama suggested on Wednesday that the objective had broadened. ?The goal is to make sure that the Libyan people can make a determination about how they want to proceed, and that they?ll be finally free of 40 years of tyranny and they can start creating the institutions required for self-determination.? That is parallel to the objective the United States set in Afghanistan in 2001 and in Iraq in 2003.

It sure is! But a few weeks later, despite dogged bombing of Tripoli, we still hadn?t taken him out. Time to finally come clean? Looks that way:

A U.N. resolution justifies the targeting of Libyan leader Moammar Gadhafi, a senior NATO military official with operational knowledge of the Libya mission told CNN Thursday?

The resolution said forces could use ?all necessary measures? to protect civilians.

NATO Secretary General Anders Fogh Rasmussen said Wednesday it is time to start planning for what to do in Libya after Gadhafi?s departure ?because Gadhafi?s reign of terror is coming to an end.?

That?s actually worse than the War Powers Act maneuvering, isn?t it? The WPA is constitutionally ambiguous, so Obama refusing to seek congressional approval of the mission isn?t a groundless endeavor. Lying to the Security Council about not seeking regime change ? per Obama?s own words in March ? and then turning around and citing that resolution as authority for regime change is something altogether different. What an interesting multilateralist Obama?s turned out to be. He insists on operating through international channels, and then he makes a mockery of those channels by using them unwillingly as cover for whatever his own policy goal is. In a way, he?s expressed more contempt for UN legitimacy than Bush ever did.

Well, at least we?ll soon be rid of Qaddafi. Exit quotation: ?We are confident that history will see the wisdom of your country in debating these issues.?

Report: Elizabeth Edwards Left Behind Video Testimony Against Her Husband

Elizabeth Edwards, who passed away from cancer in early December of last year, has left a damning video testimony highlighting what she knew about her husband John Edwards? extramarital affair with his former campaign worker, Rielle Hunter ? this, at least, according to an exclusive by The National Enquirer, the publication that first broke the story of Edwards? affair and subsequent child with Hunter.

Reports the Enquirer, quoting a ?source close to the scandal?:

Elizabeth wanted to exact revenge against John for destroy�ing their 33-year marriage and family by cheating with Rielle.

It was Elizabeth?s idea to secret�ly record a video and tell what knew of the affair and John?s horrific betrayal.

The source added that Edwards then passed the video on to a friend, asking that it be sent to prosecutors in the case against her husband.

Last week, John Edwards pleaded not guilty following a federal grand jury?s indictment on charges he conspired to cover up his affair during his 2008 campaign by ?secretly obtaining,? donors? contributions and later misreporting these donations.
